Welcome to the www.myjcos.com website (the “Site”). The Site is owned and operated by Sentique International LLC, Please review the following terms and conditions carefully as they constitute a legally binding agreement.

By accessing this Site, you agree to be bound by these Web Site Terms and Conditions of Use (“Terms of Use”) and all applicable laws and regulations, local or otherwise. If you do not agree with any of these terms, you are prohibited from using or accessing this Site.

Sentique reserves the right, in its sole discretion, at any time, without notice and for any reason to revise these Terms of Use. By using this Site you are agreeing to be bound by the then current version of the Terms of Use. If you do not agree to changes to the Terms of Use, please do not use the Site.

 

3. Use 

You acknowledge and agree that all content, information and materials (collectively “materials”) available on the Site are protected by intellectual property and other laws. Except as expressly authorized by Sentique, any use, copy, reproduction, display, performance, modification or transmission is strictly prohibited. It is our policy to decline unsolicited suggestions and ideas. Notwithstanding our policy, any materials or information, including but not limited to data, texts, music, sounds, photographs, graphics, videos, messages, remarks, ideas, comments or concepts that you transmit or post to the Site (“Submitted Information”) will be considered non-confidential and non-proprietary. Sentique will have no obligations to you with respect to the Submitted Information, and may, at its option and without compensation to you, disclose, distribute, copy, incorporate, or otherwise use the Submitted Information for any and all commercial and non-commercial purposes. By submitting materials to the Site you warrant that you are the owner of the material or have been granted permission to submit such material. By submitting materials to our Site, you grant Sentique a worldwide, irrevocable, non-exclusive, royalty-free license to use, reproduce, adapt, publish, translate and distribute the Submitted Information in any existing or future media. You also grant to Sentique the right to sub-license these rights, and the right to bring an action for infringement of these rights.

 

Sentique reserves the right to edit or remove any materials submitted to the Site or that is stored on Sentique servers or hosted or published upon the Site. Notwithstanding Sentique’s rights, Sentique does not undertake to monitor the submission or publication of such content.

 

You agree that Sentique may use any information you provide for marketing and promotional purposes. Sentique is and shall be under no obligation to maintain any user comments or contents in confidence; to pay any user compensation for any user content; or to respond to any user content or comments.

Sentique reserves the right, for any reason, in its sole discretion, to terminate, suspend or change any aspect of the Site including but not limited to content, features or hours of availability. 7. Limitations

In no event shall Sentique or its suppliers be liable for any damages, incidental or consequential, (including, without limitation, damages for loss of data or profit or due to business interruption) arising directly or indirectly out of the use or inability to use the Site, content, materials and functions, even if Sentique or a Sentique authorized representative has been notified orally or in writing of the possibility of such damage. Because some jurisdictions do not allow limitations on implied warranties, or limitations of liability for consequential or incidental damages, these limitations may not apply to certain users. Should that be the case, Sentique’s total liability to you for all damages, losses and causes of action, whether in contract or tort, including but not limited to negligence, arising from use of the Site or from Terms of Use shall not exceed one hundred dollars ($100.00) in the aggregate.

The materials appearing on the Site could include technical, typographical, or photographic errors. Sentique does not warrant that any of the materials on the Site are accurate, complete, or current. At any time, without notice, Sentique may change any material but Sentique does not make any commitment to do so.

Sentique has not reviewed all of the sites linked to its Site and is not responsible for the contents of any such linked site. The inclusion of any link does not imply endorsement by Sentique and use of any such linked web site is at the user's own risk.

You may provide a hypertext link to the Site on another website, provided that: (a) the appearance, position and other aspects of the link may not be such as to damage or dilute the goodwill associated with Sentique’s name and trademarks; (b) the appearance, position and other aspects of the link may not create the false impression that an entity is associated with or sponsored by Sentique; (c) when activated by a user, the link must display the Site full-screen and not within a “frame” on the linked website; and (d) Sentique reserves the right to revoke its consent to the link at any time in its sole discretion.

You agree that Sentique may send electronic email to you to advise you of changes or additions to the Site, about any products or services offered, or for such other purpose(s) as Sentique deems appropriate.

 

 

12. Orders 

Sentique reserves the right, in its sole discretion to refuse any order placed, and may limit or cancel quantities. Sentique reserves the right to prohibit, cancel or limit any order that, in our sole judgment, appears to be placed by dealers, resellers or distributers.

 

 

13. Choice of Law; Forum 

 Any claim relating to Site shall be governed by and in accordance with the laws of the State of New York without regard to its conflict of law provisions. Any controversy involving Sentique arising from or in any way related to these Terms of Use or your use of the Site shall be heard in the appropriate State or Federal court in New York County, New York and you irrevocably consent to the jurisdiction of such courts.

 

 

14. Indemnification 

 You agree to defend, indemnify and hold Sentique, and its officers, directors, employees, agents, licensees, successors and assigns harmless from and against any and all claims, losses, damages, liabilities, costs and expenses (including reasonable attorneys’ fees) incurred or suffered by them in connection with any claim arising out of or related to: (a) your use of the Site; (b) your breach or violation of these Terms of Use; (c) your dispute with another user; or (d) the unauthorized access to any password-protected area of the Site using your password. Sentique reserves the right, at its own expense, to assume the exclusive defense and control of any matter otherwise subject to indemnification by you, and you shall not in any event settle or otherwise dispose of any matter without the prior written consent of Sentique

 

 

15. Termination 

These Terms of Use constitute a binding legal agreement between you and Sentique until terminated by you or Sentique. Sentique may terminate at any time, without notice, in its sole discretion.  However, if you become dissatisfied with the Site, your only recourse is to immediately discontinue use of the Site.

  

 

16. General Provisions 

If any provision of these Terms of Use is held to be invalid or unenforceable by a court of competent jurisdiction, then such provision shall be enforced to the maximum extent possible so as to effect the intent of these Terms of Use, and the remainder of the Terms of Use shall continue in full force and effect. The failure by either you or Sentique to exercise or enforce any right or provision of these Terms of Use shall not constitute a waiver of such right or provision. You agree that any cause of action arising out of or related to the Site or these Terms of Use that you want to pursue must commence within one (1) year after the cause of action arose; otherwise, such cause of action is permanently barred. This agreement comprises the entire agreement between you and Sentique, and supersedes all prior agreements between the parties regarding the subject matter contained herein. All provisions in these Terms of Use regarding representations and warranties, indemnification, disclaimers, and limitation of liability shall survive the termination of these Terms of Use.

 

 17. Merchandise

The Site may make available listings, descriptions, and images of goods and services (collectively, “Products”). Such Products may be made available by us or by third parties. We make no representations as to the completeness, accuracy, reliability, validity, or timeliness of such listings, descriptions, or images (including any features, specifications, and prices contained on the Sites). Such information and the availability of any Product are subject to change at any time without notice.

We have made efforts to accurately display the attributes of Products, including the applicable colors. However, as the actual colors you see will depend on your monitor, we cannot guarantee that your monitor's display of any color will accurately reflect actual product color or finish. In addition, certain weights, measures, and similar descriptions are approximate and are for convenience only.

While our goal is to provide accurate information, product packaging may contain more and/or different information than that provided on MyJCOS Site, including the product description, ingredient, and other information. Always read labels, warnings, directions, and other information provided with the product before using it.

For additional information about a product, please contact the manufacturer. If you find a product is not as described, your sole remedy is to return it in unused condition, in accordance with MyJCOS's return policy. It is your responsibility to ascertain and obey all applicable local, state, federal, and foreign laws regarding the purchase, and use of any Product.

 

 18. Placing an Order

  

A. Order Acceptance and Billing

You represent and warrant that we have the right to use any credit card or other means of payment that you provide to us. By providing payment card information to us, you authorize us to store and use the card as a payment method for purchases made through your MyJCOS.com account. All billing information you provide to us must be truthful and accurate. Providing any untruthful or inaccurate information is a breach of these Terms of Use and may result in cancellation of your order. We reserve the right to refuse or cancel an order for any reason including limitations on quantities available for purchase, inaccuracies, or errors in product or pricing information, or problems identified by our credit and fraud avoidance department. If your order is canceled after your credit card (or other payment account) has been charged, we will issue a credit to your credit card (or other applicable payment account) in the amount of the charge. We will attempt to contact you if all or any portion of your order is canceled or if additional information is required to accept your order.

By confirming your purchase at the end of the checkout process, you agree to accept and pay for the Products, as well as all shipping and handling charges and applicable taxes.

Sentique reserves the right, including without prior notice, to limit the quantity of items purchased per person, per household, or per order for any reason. We will attempt to notify you should such limits be applied. Sentique also reserves the right, at our sole discretion, to prohibit sales to dealers or resellers. For purposes of these Terms of Use, “reselling” will be defined as purchasing or intending to purchase any Product(s) from Sentique for the purpose of engaging in a commercial sale of the same Product(s) to a third party.

In addition to any other remedies available to it, Sentique may in its sole discretion restrict or terminate your account, or cancel or refuse orders for violations of, or abuse of the MyJCOS returns policy.

 

B. Pricing Information; Availability

Sentique cannot confirm the price or availability of an item until after your order is placed. Pricing or availability errors may occur on the MyJCOS Sites or through Marketplace Retailers. Sentique reserves the right to cancel any orders containing pricing or availability errors, with no further obligations to you, even after your receipt of an order confirmation or shipping notice from Sentique. Sentique may, at its discretion, either contact you for instructions or cancel your order and notify you of such cancellation.

 

C. Promotional Codes

Promotional codes are limited in nature and may expire or be discontinued with or without notice. Promotional codes are void where prohibited by law. Promotional codes may not be copied, sold, or otherwise transferred. They are not redeemable for cash and are subject to cancellation or change at any time for any reason without notice. We reserve the right in our discretion to impose conditions on the offering of any promotional code.

  

19. Domestic Shipping

 Shipping rates for many items are based on weight. You can see an estimate of shipping rates when you add items to cart and use the 'Estimate Shipping' calculator via the Shipping section in your cart. *Please note all major carriers have applied holiday rates and are respectfully reflected on all shipping options we offer. Please refer to the shipping calculator in the checkout to verify rates.

Packages are shipped within an average of 24-48 hours with events such as Sales, Promotions, etc. leading to extra handling time.

Free Shipping

We offer free shipping for all US domestic orders over $30 (excluding tax).
